Foreseeable misconduct and misuse includes any AccelerOme system use that does not comply with the intended use defined and documented by Thermo Scientific™ and stated in this document or any other applicable document, but results from erroneous human behavior. Thermo Scientific™ does not assume any liability for injury or death of persons or of property damage resulting from foreseeable misconduct and misuse, even if not mentioned subsequently. The risk analysis performed by Thermo Scientific™ includes the following foreseeable misconduct or misuse cases:
- Using the AccelerOme instrument in a wet environment.
- Using the AccelerOme instrument with a manipulated door.
- Bridging door contacts or casing cover contacts to use the AccelerOme instrument with open casing doors or open covers.
- Reaching into the AccelerOme instrument that is not switched off, for dusting and wet cleaning.
- Reaching into the AccelerOme instrument with a manipulated door.
- Reaching into the AccelerOme instrument while wearing loose textiles, such as scarfs, tissues, ties, or wide clothing or jewelry or with loose long hair.
- Complete or partial dismantling of protective elements such as safety devices, casing parts, casing covers, doors and/or covering plates, not mentioned in any written instructions from Thermo Scientific™, to carry out maintenance, repair or replacement of defective parts.
- Any modification of the AccelerOme instrument not permitted by Thermo Scientific™ in written form.
- Not reading this guide or any other document related to the AccelerOme system.
- Service and maintenance work on electrified systems or systems under pneumatic pressure.
- Opening the electrical cabinet on the back of the AccelerOme instrument by persons not authorized and without professional education for this work.
- Replacing components and parts of the AccelerOme instrument with unsuitable spare parts.
- Not performing or incorrectly performing maintenance or repair work, and not replacing consumables or worn out parts.
- Not reading this document or any other applicable documents for the AccelerOme system.
- Nonobservance of safety instructions while moving, transporting, operating, servicing or maintaining the AccelerOme system.
- Nonobservance of technical instructions for operation or maintenance.
- Operation with fluids and inks not expressively approved in written form by Thermo Scientific™.
- Operation in environments that present a risk of fire or explosion.
- Use of magnetic devices or magnetized tools near electronic parts.
- Using the tray positions C, E, and F on the instrument deck for storing vials, reagents, or flammable liquids or for any other purpose.
- Inserting cigarettes, cigars, e-cigarettes or any other flammable items into the instrument.
- Wet cleaning of the AccelerOme instrument and/or dripping down of cleaning water or cleaning agents on the AccelerOme instrument components, spraying with high pressure cleaners or in case of fire, the use of extinguishers on the AccelerOme instrument that is not switched off.
In case of any foreseeable misconduct or misuse, the validity of the EC conformity declaration lapses and thus, automatically, the liability and warranty of Thermo Scientific™. The foreseeable misconduct or misuse cases listed here, as well as any foreseeable and non-foreseeable misconduct and misuse cases not listed here are not permitted activities. Thermo Scientific™ does not assume any form of liability for any personal or property damage resulting from such non-permitted activity. Thermo Scientific™ reserves the right to partly or completely cancel the warranty of the AccelerOme system in case of such misconduct or misuse.
